1. About these terms

This website is operated by Praxa Tech Pty Ltd (ABN 34 699 673 124), an Australian company. By using the site you agree to these terms. If you do not agree with them, please do not use the site.

2. Information on this site

The site describes what we do and how we work. It is general information, not advice about your specific business, and it should not be relied on as the sole basis for a decision.

We take care to keep the site accurate and current, but we do not warrant that everything on it is complete, error free or up to date at all times. Anything we say about third-party software reflects what we see in our own discovery work with Australian and New Zealand manufacturers and wholesalers. Those products active development, so check current capability with the vendor before making a decision.

3. Pricing and timeframes

Prices and timeframes shown on this site, including the figures on our pricing page, are indicative of the work we typically do. They are not an offer and they are not a quote.

A binding price and date is provided only in a written proposal issued after discovery. Once that proposal is accepted, the price is fixed on the terms set out in it.

4. Enquiries and the free demo

Submitting a form on this site starts a conversation. It does not create a contract and it does not oblige either of us to proceed.

Where we build a free demonstration system for you, it is provided for evaluation only. It is not a production system, it carries no warranty, it should not be used to run any part of your business, and it remains our property. Any material you give us to build it stays yours, and we handle it in accordance with our privacy policy.

5. Intellectual property in this site

The content of this site, including text, layout, design, code and the Praxa Tech name and wordmark, is owned by Praxa Tech Pty Ltd or used under licence.

You may read it, print it, and share links to it. You may not reproduce it commercially, republish it as your own, or use our name or wordmark in a way that suggests an association or endorsement that does not exist.

This clause is about the website only. Intellectual property in software we build for a client is dealt with in that client's agreement, and on final payment it transfers to the client. See after go-live.

6. Third-party names and links

Product and company names mentioned on this site are the trademarks of their respective owners. Praxa Tech is not affiliated with, endorsed by, partnered with or a reseller for any of them, and references to them are for identification and comparison only.

Where we link to another website, we do so for convenience. We do not control those sites and we are not responsible for their content.

7. Acceptable use

You agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorised access to the site or any related system
• Interfere with the site's operation or security, including its anti-spam measures
• Use automated means to scrape the site at a volume that degrades it for others
• Submit false information, or another person's details, through our forms

8. Availability

We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of the site at any time without notice.

9. Your rights under consumer law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

If you are in New Zealand, nothing in these terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, to the extent those Acts apply to you.

Where our liability can be limited, it is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

10. Limitation of liability

Subject to clause 9, and to the extent permitted by law, Praxa Tech Pty Ltd is not liable for any loss or damage arising from your use of this site or your reliance on information published on it, including indirect or consequential loss, loss of profit, or loss of data.

11. Privacy

How we handle personal information is set out in our privacy policy, which forms part of these terms.

12. Changes to these terms

We may update these terms from time to time. The current version is always at praxatech.com/terms, with the date it was last updated at the top of the page. Continuing to use the site after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia and the courts of appeal from them.
